Nod Terms of Use
Effective date: 8 October 2026.
These Terms are between you and Stuck In The Sand LLC, doing business as Unstuck Labs, located in 3100 Clarendon Blvd., #800, Arlington, Virginia 22201, United States, the operator of Nod. Contact hello@unstucklabs.com. They cover the Nod website and native apps. Please read the Privacy Policy to understand information processing.
1. Eligibility and agreement
You must be 18 or older, capable of entering an agreement, and legally permitted to use Nod. By accepting these Terms during setup, you agree to them. Do not use Nod on behalf of someone else without their authority. The app is a general adult utility, not a children's service.
2. What Nod does
You establish a connection with someone you recognise in person by scanning a temporary code, comparing the six-digit number on both devices and both confirming. You can then send a short question. The connected person can approve or decline it using a passkey. An unanswered request expires after 90 seconds.
An approval means the connected credential signed the displayed question. Green is a visual indication of that approval while it is current. Red indicates a decline. Amber indicates no reply before the check expires. Neither a decline nor no reply proves that someone is an impostor. A green screen does not establish legal identity, who is speaking, the authenticity of audio or video, physical location, ownership of a bank account, honesty, capacity, or the safety of a transaction. Nod is not an emergency service, identity-certification service, deepfake detector, payment authorisation system, or replacement for independent checks.
3. Use it carefully
Connect only with someone you recognise while you are physically together. Compare both codes and names. Approve only when the displayed question accurately describes what you are doing at that moment. An approval applies to that question, not later conversations or requests. If you suspect fraud, pause and contact the person using a number you already trust. Verify payment details independently. Never share a passkey secret, private key, PIN, one-time banking code, or recovery code with someone who claims to represent Nod.
You are responsible for safeguarding your devices and passkey-provider account. Passkeys may sync across devices; biometrics are controlled by the platform and may have PIN or other fallbacks. Nod cannot guarantee that a credential is exclusive to one physical person. Re-pair in person when a credential changes or a connection becomes uncertain.
4. Acceptable use
Do not use Nod to impersonate, defraud, threaten, harass, coerce an approval, monitor someone without permission, evade legal restrictions, or obtain information you are not entitled to receive. Do not interfere with the service, exploit another person's credentials, send unwanted repeated checks, or try to defeat access controls. Security research must avoid other people's data and disruption; send a report to hello@unstucklabs.com. We may apply rate limits and suspend abusive access proportionately, with notice where feasible and legally required.
5. Accounts, data and termination
You may disconnect contacts or delete your Nod in settings. Deletion requires passkey confirmation and is irreversible. It removes associated active-database records, including shared Nod history, subject to the Privacy Policy's backup/log and lawful-retention details. Copies outside Nod remain outside our control. Loss of a passkey may prevent account access; do not assume we can recover it or bypass its protection. You can request assistance through the support/privacy contact.
We may change or discontinue the service. For material changes affecting existing use, we will provide notice where reasonably possible and legally required. If we end an account or the service, we will provide any access, export or deletion rights required by law. You can stop using Nod at any time.
6. Price, software and ownership
This release is free to use and has no purchases, subscriptions, advertising or paid account tier. Any future paid feature would need clear terms and your agreement before a charge. Your network provider or other services may charge separately.
We grant you a limited, non-exclusive right to use the app for lawful purposes under these Terms and the applicable store's rules. You retain rights in information you provide; you permit us to process it only as needed to provide and protect Nod as described in the Privacy Policy. Nod's code, brand and design remain with their rights holders. Open-source software retains its own licence terms, listed in the launch materials and applicable app notices.
7. Availability and responsibility
Subject to mandatory legal rights, Nod is provided on an “as available” basis. We do not promise uninterrupted service, universal device compatibility, perfect security, or detection or prevention of fraud. Outages, provider failures, device compromise, errors and mistaken approvals can occur. Maintain independent ways to contact your people.
To the extent permitted by law, we exclude liability for indirect or consequential losses arising from use of Nod. These Terms do not exclude or limit liability that cannot lawfully be excluded or limited, including applicable consumer rights, fraud, deliberate misconduct, or any other mandatory protection. They do not impose a mandatory arbitration clause or a class-action waiver.
8. Law and disputes
Virginia law governs these Terms, except that mandatory laws and consumer protections where you live continue to apply. Subject to those protections and any jurisdiction required by law, disputes may be brought in courts with jurisdiction in Arlington County, Virginia.. Any choice of law or forum must preserve mandatory protections and rights available where you live. You may raise a concern at hello@unstucklabs.com before pursuing formal remedies; contacting us is not a waiver of legal rights.
9. Apple and Google distribution
These Terms supplement the relevant store's distribution terms. Where Apple's standard end-user licence applies, it also governs the iOS app licence; this document primarily governs the Nod service. Apple and Google do not operate Nod, verify Nod approvals, or provide its support. Store approvals do not certify identity or security.
10. Changes and contact
We will identify material revisions and ask for renewed agreement where required. If any provision is unenforceable, the remaining provisions continue only to the extent permitted by law. For support, contact hello@unstucklabs.com. For privacy requests, contact hello@unstucklabs.com.
